GRAIN GRABBERS, LTD., will not disclose buyer’s information to third parties except as necessary to process your order.
GRAIN GRABBERS, LTD., hereby warrants that the grain auger add-on individual units or kit components (“GRAIN GRABBER DEVICE”) will be free from manufacturing defects for a period of one (1) year from the date of purchase.
EXCLUSIONS: This warranty shall not apply if:
(1) The GRAIN GRABBER DEVICE is damaged during installation or otherwise; or
(2) The GRAIN GRABBER DEVICE has not been properly installed and maintained; or
(3) GRAIN GRABBER DEVICES have been repaired or altered in any way by persons other than the Grain Grabbers LTD’s authorized service personnel; or
(4) There is any damage resulting from accident, acts of God, alteration,negligence, misuse, or abuse;
(5) Depreciation or deterioration of machinery or auger components other than the GRAIN GRABBER DEVICE; or
(6) The GRAIN GRABBER DEVICES have been installed in any manner which inhibits or prevents the operations of any safety devices.
In order to exercise its rights under this warranty, the purchaser must provide Grain Grabbers LTD with a written notice of claim within thirty (30) days after the purchaser determines or is advised that the GRAIN GRABBER DEVICE is defective. Along with the notice, the Purchaser shall forward to Grain Grabbers LTD, 11977 State Route 49, Edon OH 43518, either the part which is claimed to be defective. Upon receiving the part alleged to be defective, Grain Grabbers LTD will either replace the defective part or will notify Purchaser that the warranty does not apply.
THE FOREGOING WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABLITY AND FITNESS FOR A PARTICULAR PURPOSE. THE FOREGOING WARRANTY IS ALSO IN LIEU OF ANY OTHER OBLIGATIONS AND LIABILITES ON THE PART OF GRAIN GRABBERS LTD. AND ALL OTHER WARRANTIES ARE EXPRESSLY EXCLUDED. GRAIN GRABBERS LTD NEITHER ASSUMES NOR AUTHORIZES ANY PERSON TO ASSUME FOR IT ANY OTHER OBLIGATION OR LIABILITY WHATSOEVER IN CONNECTION WITH THE GRAIN GRABBER DEVICE. IN NO EVENT SHALL GRAIN GRABBERS LTD. BE LIABLE FOR SPECIAL CONSEQUENTIAL OR INCIDENTAL DAMAGES FOR BREACH OF SAID WARRANTY NOR IMPROPER SELECTION OF THE GRAIN GRABBER DEVICE FOR A PARTICULAR APPLICATION.
